These Terms of Service ("Terms") govern your access to and use of the FunAnyway app, website, and related services (collectively, the "Services"). By creating an account or using the Services, you agree to these Terms. 1. Eligibility and Registration - You must be at least 13 years old to use the Services. - If you are under 18, you must have permission from your parent or legal guardian. - You are responsible for keeping your account credentials secure and for all activity under your account. - You agree to provide accurate account information and keep it updated. 2. Your Use of the Services - You may use the Services only for lawful purposes and in accordance with these Terms. - You agree not to misuse the Services, including by: - violating applicable laws or regulations; - harassing, threatening, or abusing other users; - posting illegal, infringing, deceptive, or harmful content; - attempting unauthorized access to systems or accounts; - interfering with platform integrity or security. 3. User Content - A "Moment" is one real-life image plus optional text that you choose to share with Momo. Moments and other materials you choose to submit are "User Content." - You remain responsible for your User Content and represent that you have all necessary rights to share it. - You grant Zaisland Inc. a non-exclusive, worldwide, royalty-free license to host, store, reproduce, display, and process User Content solely as needed to provide, operate, secure, and support the Services you request. - We may remove or restrict User Content that violates these Terms or applicable law. 4. Safety and Moderation - To maintain a safe platform, we may monitor abuse signals and enforce community rules. - We may suspend or terminate accounts involved in serious or repeated violations. 5. Intellectual Property - The Services, including software, design, trademarks, and platform content (excluding User Content), are owned by Zaisland Inc. or its licensors and are protected by law. - You may not copy, modify, distribute, reverse engineer, or create derivative works from the Services except as permitted by law. 6. Account Deletion and Termination - You can request account deletion from within the app. - Upon deletion, your account and related data will be processed according to our Privacy Policy and applicable law. - We may suspend or terminate access if you breach these Terms or if required for legal or security reasons. 7. Disclaimers and Limitation of Liability - The Services are provided on an "as is" and "as available" basis. - To the maximum extent permitted by law, Zaisland Inc. disclaims warranties of any kind, express or implied. - To the maximum extent permitted by law, Zaisland Inc. is not liable for indirect, incidental, special, consequential, or punitive damages, or loss of profits, data, or goodwill. 8. Changes to the Services or Terms - We may update these Terms from time to time. - If we make material changes, we will update the "Last Updated" date and provide notice where required. - Continued use of the Services after updates means you accept the revised Terms. 9.
